These Terms of Service ("Terms") constitute a legally binding agreement between you ("User," "you," or "your") and Dr. Hines Inc., a coaching practice operating in Broken Arrow, Oklahoma ("Company," "we," "us," or "our"), governing your access to and use of the Boundary Agreement platform, including all associated websites, applications, tools, assessments, AI features, and services (collectively, the "Service").
By accessing or using the Service, creating an account, purchasing an assessment, completing an assessment, or clicking "I agree" (or similar affirmation), you acknowledge that you have read, understood, and agree to be bound by these Terms and our Privacy Policy. If you do not agree, do not use the Service.
The Boundary Agreement is a couples communication and boundary-building platform. It provides:

It is NOT therapy, counseling, psychological treatment, psychiatric care, medical advice, legal advice, or a substitute for any professional service. The Service does not diagnose, treat, cure, or prevent any mental health condition, psychological disorder, or medical condition.
The Company is operated by Dr. Johnathan Hines, who holds a Doctorate in Christian Counseling (DCC). Dr. Hines is a certified Christian coach, NOT a Licensed Professional Counselor (LPC), Licensed Marriage and Family Therapist (LMFT), Licensed Clinical Social Worker (LCSW), psychologist, or psychiatrist. The assessments, AI-generated content, coaching tools, and boundary proposals provided through this Service are coaching tools and do not constitute clinical, therapeutic, psychological, or medical services.
The AI features within the Service (including but not limited to boundary proposals, coaching chatbot responses, and suggestion algorithms) are generated by artificial intelligence models. AI-generated content is not a substitute for professional human judgment. The AI does not have the ability to fully understand the complexity of your relationship, your history, your mental health, or your specific circumstances.

The Service is not designed to address domestic violence, abuse, imminent threats of harm, suicidal ideation, or any crisis situation. If you are experiencing any of these situations, please contact:
The Company is not liable for any harm resulting from use of the Service in a crisis situation for which it was not designed.
You must be at least 18 years of age to use the Service. By using the Service, you represent and warrant that you are at least 18 years old and have the legal capacity to enter into a binding agreement. The Service is designed for use by two consenting adults in a romantic relationship.
Access to the assessment is provided via unique codes generated upon purchase. You are responsible for keeping your assessment code confidential. Each code is assigned to one individual and should not be shared with anyone other than the intended recipient. The Company is not responsible for unauthorized access resulting from your failure to protect your assessment code.
By purchasing the Service, creating an account, or entering your email address, you consent to receive the following types of communications from Dr. Hines Inc.:
You may opt out of non-transactional emails at any time by clicking the "Unsubscribe" link at the bottom of any email or by contacting support@drhinesinc.com. Opting out of non-transactional emails does not affect transactional emails required for Service delivery.
We will never sell your email address to third parties for marketing purposes. See our Privacy Policy for full details on how your contact information is used and protected.
The Service is offered at the price displayed at the time of purchase. All payments are processed through Stripe, a third-party payment processor. By making a payment, you also agree to Stripe's terms of service. The Company does not store credit card numbers or sensitive financial data on its servers.
Prices are subject to change at any time without notice. Price changes do not affect purchases already completed.

All refund requests must be submitted in writing to support@drhinesinc.com within 14 days of purchase. Refunds are processed within 5 to 10 business days to the original payment method.

The Company is not responsible for inaccurate results caused by dishonest or coerced responses.
The boundary agreement generated by the Service is a communication tool between partners. It is NOT a legally binding contract, court order, prenuptial agreement, postnuptial agreement, or enforceable legal document. It is a voluntary commitment between two individuals to honor mutually agreed-upon boundaries.
The Company makes no representation that the boundary agreement will be enforceable in any court of law or legal proceeding. If you need a legally binding agreement, consult a licensed attorney in your jurisdiction.
The Service uses artificial intelligence to generate boundary proposals, coaching responses, and suggestions. You acknowledge and agree that:
The Service may be used by or recommended by licensed therapists, counselors, coaches, pastors, clergy, mediators, and other practitioners ("Practitioners"). The following terms apply to Practitioner use:
Practitioners who recommend, distribute, or use the Service are independent professionals. They are not employees, agents, contractors, or representatives of Dr. Hines Inc. The Company does not supervise, direct, control, or endorse the professional services of any Practitioner.
Practitioners are solely responsible for their own professional conduct, licensing, ethics compliance, and any clinical or therapeutic services they provide to their clients. The Company does not provide clinical supervision and is not responsible for the professional judgment, recommendations, or actions of any Practitioner.
Practitioners may purchase assessment credits at wholesale pricing for use with their clients. This is a product purchase, not a referral fee, affiliate commission, or kickback arrangement. The Practitioner is the buyer of a coaching tool, which they may offer to their clients at their discretion and at whatever price they determine appropriate.
Inclusion in any Practitioner directory or referral network does not constitute endorsement, recommendation, or certification by Dr. Hines Inc. The Company does not verify the licensure, credentials, malpractice history, or qualifications of any Practitioner. Users are responsible for verifying the credentials and qualifications of any Practitioner they engage.
The Company shall not be liable for any damages, claims, or losses arising from the professional services, advice, conduct, negligence, or malpractice of any Practitioner who uses or recommends the Service.
The Service may be used by churches, ministries, and faith-based organizations ("Ministries") for their congregants or members. Ministries that recommend or distribute the Service are responsible for their own use. The Company does not provide theological guidance through the Service and is not responsible for how Ministries incorporate the assessment results into their pastoral care, counseling programs, or ministry activities.
All content, assessments, questions, algorithms, AI models, code, designs, logos, branding, and materials within the Service are the intellectual property of Dr. Hines Inc. and are protected by copyright, trademark, and other intellectual property laws. You may not copy, reproduce, distribute, modify, reverse-engineer, decompile, or create derivative works from any part of the Service without prior written consent from the Company.
The boundary agreement document generated for your relationship is provided for your personal use. You may print, save, and share it with your partner, your practitioner, or your legal counsel. You may not sell, distribute, or commercially exploit the document or any portion of the Service.
Your use of the Service is also governed by our Privacy Policy, which is incorporated into these Terms by reference. By using the Service, you consent to the collection, use, and storage of your information as described in the Privacy Policy.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, Dr. Hines Inc., its owner, officers, employees, agents, contractors, AI service providers, and affiliates shall not be liable for any indirect, incidental, special, consequential, punitive, or exemplary damages, including but not limited to damages for loss of profits, goodwill, data, or other intangible losses, resulting from:
IN NO EVENT SHALL THE TOTAL LIABILITY OF DR. HINES INC. EXCEED THE AMOUNT YOU PAID FOR THE SERVICE.
You agree to indemnify, defend, and hold harmless Dr. Hines Inc., its owner, officers, employees, agents, and affiliates from and against any and all claims, liabilities, damages, losses, costs, and expenses (including reasonable attorneys' fees) arising out of or relating to: (a) your use of the Service; (b) your violation of these Terms; (c) your violation of any rights of a third party; (d) any dispute between you and your partner; or (e) any claim that the Service caused or contributed to any harm in your relationship.
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, STATUTORY, OR OTHERWISE. THE COMPANY SPECIFICALLY DISCLAIMS ALL IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, AND ANY WARRANTIES ARISING FROM COURSE OF DEALING OR USAGE OF TRADE.
THE COMPANY DOES NOT WARRANT THAT:
Any dispute, controversy, or claim arising out of or relating to these Terms or the Service shall be resolved through binding arbitration administered by the American Arbitration Association under its Consumer Arbitration Rules, unless you opt out within 30 days of first using the Service by emailing legal@drhinesinc.com with the subject line "Arbitration Opt-Out." Arbitration shall take place in Tulsa County, Oklahoma.
CLASS ACTION WAIVER: You agree that any dispute resolution proceedings will be conducted only on an individual basis and not in a class, consolidated, or representative action. You waive any right to participate in a class action lawsuit or class-wide arbitration.
These Terms shall be governed by and construed in accordance with the laws of the State of Oklahoma, without regard to its conflict of law provisions. Any legal action or proceeding not subject to arbitration shall be brought exclusively in the state or federal courts located in Tulsa County, Oklahoma.
The Company reserves the right to terminate or suspend your access to the Service at any time, for any reason, without notice. Grounds for termination include but are not limited to: violation of these Terms, abusive behavior toward the Service or its representatives, fraudulent activity, or use of the Service for purposes other than its intended use.
The Company reserves the right to modify these Terms at any time. Changes will be posted on this page with an updated "Last Updated" date. Your continued use of the Service after any changes constitutes acceptance of the modified Terms. It is your responsibility to review these Terms periodically.
If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary so that these Terms shall otherwise remain in full force and effect.
These Terms, together with the Privacy Policy and any other agreements or policies referenced herein, constitute the entire agreement between you and Dr. Hines Inc. regarding the Service and supersede all prior agreements, understandings, and communications.
